Appellate Review

The Constitution affords you certain rights you cannot be deprived of by the government, or those acting under the color of law. The Florida Supreme Court has promulgated special rules for “complex” litigation, which they define as cases “likely to involve complicated legal or case management issues and that may require extensive judicial management to expedite the case, keep costs reasonable, or promote judicial efficiency.” Click here to learn more.

In a civil case, either side may appeal a judgment, whether it results from a jury verdict or bench trial. An appeal is not a retrial or a new trial of the case and no new evidence is considered. Rather, the appellate court must decide whether some “reversible error” occurred that would warrant a new trial or other relief. Most commonly, those reasons include insufficient evidence to support a jury verdict or an abuse of the trial judge’s discretion. Click here to learn more.
